1. Introduction

Welcome to Ruby's Rental. By accessing our website, submitting an inquiry, or renting equipment from us, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

Ruby's Rental ("Company," "we," "us," or "our") provides event and equipment rental services to customers ("you," "your," "customer") subject to these Terms.

If you do not agree to these Terms, please do not use our website or services.

2. Definitions

3. Eligibility

By using our services, you represent and warrant that:

You are at least 18 years of age

You have the legal capacity to enter into a binding contract

You are authorized to make bookings on behalf of any organization you represent

All information you provide is accurate, current, and complete

You will comply with these Terms and all applicable laws

We reserve the right to refuse service, terminate bookings, or cancel accounts at our sole discretion.


4. Website Use and Intellectual Property

A. Our Content

All content on the Ruby's Rental website—including text, graphics, logos, images, product descriptions, and software—is the property of Ruby's Rental or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

Reproduce, distribute, or modify our content without written permission

Use our trademarks or branding without authorization

Copy product images or descriptions for commercial use

Scrape, crawl, or use automated means to access our website

B. Your Content

By submitting inquiries, reviews, or photos to us, you grant Ruby's Rental a non-exclusive, royalty-free license to use, reproduce, and display that content for business purposes (e.g., marketing, portfolio examples). You represent that you own or have rights to any content you submit.


5. Rentals and Bookings

A. Booking Process

Inquiries: Submitting an inquiry form does not constitute a booking. Our team will confirm availability and provide a quote.

Quotes: Quotes are valid for 30 days unless otherwise stated.

Confirmation: A booking is confirmed only when:

You receive written confirmation from Ruby's Rental (email or contract)

Any required deposit or payment has been received

A signed rental agreement (if applicable) is returned

B. Rental Period

Rental periods are specified in your booking confirmation.

Early deliveries or late pickups may incur additional fees.

Items must be available for pickup or delivery at the agreed times. Customer delays may affect setup or teardown.

C. Availability

All rentals are subject to availability.

Ruby's Rental reserves the right to substitute items of equal or greater value if specific items become unavailable due to circumstances beyond our control (with customer notification).

D. Minimum Rental Periods

Some items may have minimum rental periods (e.g., multi-day minimums for certain equipment). These will be clearly communicated during booking.


6. Payments, Deposits, and Fees

A. Pricing

Prices are quoted in USD and do not include applicable taxes unless stated.

We reserve the right to change prices at any time, but confirmed bookings will be honored at the quoted rate.

B. Deposits

A non-refundable deposit is required to secure your booking:

Deposit Amount: 50% of total rental cost

Due Date: At time of booking confirmation

The deposit secures your items and date. It is non-refundable (see Cancellation policy for details).

C. Final Payment

Balance is due 14 days before the event date.

If balance is not paid by the due date, we reserve the right to cancel the booking and retain the deposit.

D. Security Deposits

A refundable security deposit may be required:

Amount varies based on rental items and total value (typically $100–$500).

Security deposits are typically processed 3 days before delivery and refunded within 7 days after return, pending inspection.

Deductions may be made for damage, missing items, excessive cleaning, or other fees outlined in Section 9.

E. Payment Methods

We accept:

Credit/debit cards (Visa, Mastercard, American Express, Discover)

Cash App, Zelle, and Venmo (upon request)

F. Late Payments

Late payments may incur a 5% late fee per week and may result in suspension or cancellation of services.


7. Cancellations and Changes

A. Customer Cancellations

Cancellations must be submitted in writing via email to [email protected].

B. Ruby's Rental Cancellations

In the unlikely event we must cancel your booking due to circumstances within our control (e.g., inventory issues), we will:

Notify you immediately

Provide a full refund of all payments made

Attempt to assist in finding alternative solutions (though not guaranteed)

We are not liable for any additional costs you may incur due to cancellation (e.g., venue, catering, other vendors).

C. Changes to Bookings

Adding Items: Subject to availability; may adjust total cost.

Reducing Items: Must be requested in writing by 14 days before event; may affect pricing.

Date Changes: Treated as a cancellation and rebooking; subject to availability and cancellation policy.

Location Changes: Must be approved in writing; may affect delivery fees and feasibility.


8. Delivery, Setup, and Pickup

A. Delivery

Delivery fees are calculated based on distance, item quantity, and access requirements (starting at $50 within 20 miles of 27230 Southwest 138th Path, Homestead, FL 33032).

Customer must provide accurate delivery address and ensure site accessibility (e.g., elevators, stairs, parking).

If our team arrives and the site is inaccessible, additional fees may apply for return trips.

B. Setup and Teardown

Some rentals include setup/teardown; this will be specified in your booking.

For items requiring assembly, ensure the area is clear and accessible.

Our team will not move existing furniture or decor unless previously arranged.

Customer is responsible for having someone onsite to direct setup and accept delivery.

C. Pickup

Items must be available for pickup at the agreed time.

If items are not ready, additional wait time fees ($50/hour) may apply.

Late returns may incur fees equal to an additional day's rental.

D. Venue Rules

Customer is responsible for:

Complying with venue rules regarding rentals, delivery times, and access

Obtaining any required permits or permissions

Communicating venue requirements to Ruby's Rental in advance


9. Customer Responsibilities and Care of Rentals

A. Care and Use

During the rental period, you agree to:

Use items only for their intended purpose

Keep items in a safe, secure location

Not alter, modify, or attempt to repair items

Not subrent or transfer items to others

Protect items from weather, damage, and theft

B. Prohibited Uses

You may not use rental items for:

Illegal activities

Activities that violate venue or local regulations

Purposes that exceed weight or capacity limits

Outdoor use unless explicitly approved (some items are indoor only)

C. Damage, Loss, and Theft

You are responsible for all rental items from delivery until pickup.

Damage:

Normal wear and tear is expected and not charged.

You are liable for damage beyond normal wear (stains, breaks, missing parts).

Repair or replacement costs will be assessed and deducted from security deposit or invoiced.

Loss/Theft:

You are fully responsible for lost or stolen items.

Replacement cost is the full retail value of the item (not rental value).

Cleaning:

Items should be returned in the general condition received.

Excessive cleaning fees may apply (e.g., candle wax, confetti, food residue) starting at $25 per item.

Some items (e.g., linens) have specific cleaning policies—see Section 10.

D. Inspection

Customer should inspect items upon delivery. Report any issues immediately to +1 786-527-0761 or [email protected].

Discrepancies noted after delivery may be difficult to address.

Our team inspects all items upon return; you may request to be present.


10. Specific Item Policies

A. Linens

Linens should be returned free of food, wax, and excessive soil.

Shake out debris but do not wash or rinse.

Stained or damaged linens will be assessed cleaning/replacement fees ($15–$75 per item).

B. Glassware and Dinnerware

Inspect for chips/cracks upon delivery.

Handwash only; do not put in dishwashers.

Chips, cracks, or breakage are chargeable (replacement cost).

C. Furniture

Do not drag furniture across floors (use provided sliders or ask our team).

Weight limits must be observed.

Outdoor furniture may be affected by weather; take precautions.

D. Lighting and Electronics

Keep away from water unless rated for outdoor use.

Do not attempt to repair or replace bulbs without authorization.

E. Tents and Structures

Professional installation is included; do not modify or adjust.

Tents are weather-dependent; see Section 15 for weather policies.

Additional weights or stakes may be required for wind—these are for safety.


11. Liability and Insurance

A. Limitation of Liability

To the maximum extent permitted by law, Ruby's Rental shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, revenue, or business opportunities

Damage to reputation or goodwill

Costs of substitute goods or services

Personal injury or property damage arising from use of rental items

Our total liability to you for any claim arising from these Terms or your rental shall not exceed the total amount paid by you for the specific rental giving rise to the claim.

B. Assumption of Risk

You acknowledge that certain rental activities involve inherent risks. You assume full responsibility for:

Proper setup and use of items (unless installed by us)

Supervision of guests and attendees

Compliance with safety guidelines

Weather-related risks (see Section 15)

C. Insurance

We recommend that you carry appropriate liability insurance for your event. Some venues may require proof of insurance.

Ruby's Rental carries commercial liability insurance. A certificate of insurance may be available upon request (subject to 7 days notice and venue requirements).

D. Indemnification

You agree to indemnify, defend, and hold harmless Ruby's Rental, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of rental items

Your breach of these Terms

Your violation of any law or third-party rights

Claims by guests, vendors, or venue related to your event


12. Weather and Force Majeure

A. Outdoor Events

Outdoor rentals (tents, furniture, etc.) are subject to weather conditions. Ruby's Rental does not guarantee weather and is not responsible for weather-related disruptions.

B. Severe Weather (South Florida Specific)

Given our location in Homestead, Florida, we are subject to South Florida weather patterns including:

Hurricane Season (June 1 – November 30): Special precautions apply

Afternoon Thunderstorms: Common April–October; may affect setup/teardown

High Wind Events: May require tent takedown for safety

In case of severe weather warnings, we may:

Require additional safety measures (e.g., tent stakes, weights) at customer expense

Recommend or require takedown of certain items for safety

Delay delivery or pickup for safety of our team

C. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond their reasonable control, including but not limited to:

Acts of God (hurricanes, floods, earthquakes, severe weather)

Public health emergencies (pandemics, epidemics)

War, terrorism, civil unrest

Government actions or regulations

Fire, explosions, or accidents

Labor disputes or strikes

Supply chain disruptions

Power outages or utility failures

If a Force Majeure event occurs, we will:

Notify you promptly

Make reasonable efforts to reschedule or provide alternatives

If performance is impossible, issue a refund of payments made (minus non-recoverable costs)


13. Photography and Marketing

A. Event Photography

Ruby's Rental may photograph or video rental items at events for portfolio, marketing, and promotional purposes. By using our services, you grant us permission to capture and use such media, unless you explicitly opt out in writing prior to the event.

B. Opt-Out

If you prefer that your event not be photographed, please notify us in writing at [email protected] at least 7 days before the event. We will make reasonable efforts to comply, but cannot guarantee that our team or other vendors will not capture images.

C. Customer Photos

We love seeing your photos! By tagging us or sharing photos with us, you grant Ruby's Rental permission to repost or use them for marketing (with credit, where possible).


14. Disclaimers and Warranties

A. "As-Is" Basis

Rental items are provided "as is" and "as available." To the fullest extent permitted by law, Ruby's Rental disclaims all warranties, express or implied, including but not limited to:

Merchantability

Fitness for a particular purpose

Non-infringement

Course of dealing or usage of trade

B. No Guarantee of Uninterrupted Service

We do not warrant that:

Our website will be uninterrupted or error-free

Defects will be corrected

The site or servers are free of viruses or harmful components

C. Functionality

While we maintain our equipment regularly, we do not warrant that items will function without interruption during your event. You assume responsibility for having backups or alternatives (e.g., extra bulbs, extension cords).


15. Dispute Resolution

A. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

B. Informal Resolution

Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at [email protected]. We will respond within 5 business days and work in good faith to resolve the issue.

C. Binding Arbitration

If informal resolution fails, any dispute arising from these Terms or your rental shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its rules. The arbitration shall be held in Miami-Dade County, Florida, and judgment may be entered in any court having jurisdiction.

Class Action Waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

D. Small Claims Option

Notwithstanding the above, either party may bring an individual action in small claims court in Miami-Dade County, Florida if the claim qualifies and remains in small claims court.

E. Time Limit

You agree that any claim or cause of action arising out of or related to these Terms or your rental must be filed within one (1) year after such claim arose, or it is permanently barred.


16. General Provisions

A. Entire Agreement

These Terms constitute the entire agreement between you and Ruby's Rental regarding your use of our services and supersede all prior agreements and understandings.

B. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

C. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

D. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.

E. Notice

All notices shall be in writing and sent to the email or physical address provided in your account or to our contact information in Section 1.

F. Headings

Section headings are for convenience only and have no legal or contractual effect.


17. Changes to Terms

Ruby's Rental reserves the right to modify these Terms at any time. We will post changes on this page with an updated "Last Updated" date. Material changes will be communicated via email or website notice.

Your continued use of our services after changes constitutes acceptance of the modified Terms. If you do not agree, you must stop using our services and cancel any pending bookings per the cancellation policy.


18. SMS Terms (Detailed)

By opting into SMS communications from Ruby's Rental, you agree to the following:

Message Frequency: Message frequency varies based on your interactions (inquiries, bookings, reminders, promotions)

Message & Data Rates: Message and data rates may apply. Contact your mobile carrier for details

Opt-Out: You can opt out at any time by replying STOP to any message. You will receive one confirmation message that you have been unsubscribed

Carriers: Supported carriers include major US carriers; we are not liable for delayed or undelivered messages

19. Acknowledgment

By using Ruby's Rental services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
